These Terms of Service (“Terms”) are an agreement between you and Daniel R. Odio, operator of DROdio.com (“DROdio,” “we,” “us,” or “our”). By accessing or using DROdio.com and its related services (the “Site”), you agree to these Terms. If you do not agree, do not use the Site.
1. Who may use the Site
You must be at least 13 years old and legally able to enter into these Terms. If you use the Site for an organization, you represent that you have authority to bind it. You are responsible for activity under your account and for keeping your sign-in credentials secure.
2. The Site
The Site publishes articles, videos, product updates, and other materials. It may also offer accounts, newsletters, professional-profile personalization, AI chat, and ways to request contact or services. Features may change, be limited, or be discontinued at any time.
3. Acceptable use
You may not use the Site to:
- break the law or violate another person’s rights;
- upload or transmit malware, exploit vulnerabilities, bypass access controls or rate limits, or disrupt the Site;
- impersonate others, misrepresent affiliation, or use automated means to scrape or overload the Site without written permission;
- submit content you do not have the right to share, or use the Site to generate abusive, deceptive, infringing, or harmful material;
- reverse engineer the Site except where the law expressly permits it.
4. AI and personalized content
Some features use artificial intelligence and public professional information to generate answers or personalize content. AI output is probabilistic: it may be inaccurate, incomplete, offensive, or unsuitable for your circumstances. Public-source information may also be stale or incorrectly attributed.
You are responsible for evaluating output before relying on or sharing it. The Site does not provide legal, medical, financial, tax, employment, or other professional advice, and no output should be treated as a substitute for a qualified professional. Do not use the Site or its output to make high-impact decisions about another person.
5. Your content
You retain any rights you have in text and other material you submit (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, reproduce, transmit, and process Your Content only as reasonably needed to operate, secure, support, and improve the Site. You represent that you have the rights needed to submit Your Content.
Do not submit trade secrets or highly sensitive, regulated, or confidential information. Our handling of personal information is described in the Privacy Policy.
6. Newsletters and communications
If you subscribe, you authorize us to send the content you requested and related service messages. You can unsubscribe from marketing email at any time through the link in a message. We may still send non-marketing messages needed to administer an account or request.
7. Our content and rights
The Site and its original content, design, code, branding, and other materials are owned by us or our licensors and are protected by applicable law. Subject to these Terms, we give you a limited, revocable, non-transferable right to use the Site for lawful personal or internal business purposes. No other rights are granted.
Product names, logos, articles, media, and materials belonging to third parties remain the property of their respective owners. Reference to a third party does not imply endorsement.
8. Third-party services and links
The Site depends on and may link to third-party services, including authentication, email, hosting, AI, public-data, social-media, and embedded-media providers. We do not control those services and are not responsible for their content, availability, or practices. Your use of them may be governed by separate terms and privacy policies.
9. Availability and changes
We may modify, suspend, or discontinue any part of the Site, and may set or change usage limits. We do not promise that the Site will always be available, secure, or error-free. We may update these Terms by posting the revised version and changing the effective date. Continued use after an update means you accept the revised Terms.
10. Suspension and termination
You may stop using the Site at any time. We may restrict or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, or used the Site in a way that could harm it or others. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations, and dispute terms.
11. Disclaimers
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, DROdio and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Site. Our total liability for claims related to the Site will not exceed the greater of US $100 or the amount you paid us specifically for the Site during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
13. Disputes and applicable law
Before filing a claim, please contact us and give us a reasonable chance to resolve the issue informally. These Terms are governed by applicable law, without overriding consumer protections or other rights that cannot be waived in your jurisdiction.
14. General terms
These Terms and the Privacy Policy are the entire agreement about your use of the Site. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale.
